Preliminary Search

According to Article 4 of the Turkish Industrial Property Law No. 6769; Trademarks may consist of any sign like words, including personal names, figures, colors, letters, numbers, sounds and the shape of goods or their packaging, provided that such signs are capable of distinguishing the goods or services of one undertaking from those of other undertakings and being represented on the register in a manner to determine the clear and precise subject matter of the protection afforded to its proprietor.

In the trademark preliminary search reports, a trademark consisting of any type of sign is searched in national database and its registration status is evaluated within the scope of the absolute grounds for refusal in trademark registration regulated in Article 5 of the Turkish Industrial Property Law No. 6769.

Trademark preliminary search report helps:

• to identify applications/registered trademarks that are considered to be identical or similar to the trademark in the same class as the classes (NICE Classes) that are the subject of the potential trademark application in the trademark registration process.
• to examine the potential trademark application within the scope of the absolute grounds for refusal in trademark registration and to have foresight about the possible registration status of the trademark in a short time.
