Freedom to operate (FTO) refers to the freedom of an individual’s or organization's activities for commercial purposes, such as using, selling, distributing, keeping or importing/exporting a product/service without violating the industrial property rights of third parties.
Even if the developed products are registered, before starting their commercial use, the risks of infringement should be evaluated and it should be investigated whether there is freedom to operate.
In the scope of freedom to operate analysis, databases are searched for industrial property rights that have been published within the geographical borders of the countries where commercial activities are planned and whose protection period continues, and it is evaluated whether the products planned to be used commercially are within the scope of protection of the existing industrial property rights.
Freedom to operate analysis report enables;
- to determine whether there is any industrial property protection that would restrict the commercial use of a product intended to provide commercial benefit in the target countries,
- to identify the industrial property rights that require licensing for the commercial use of the developed products or services.
